Every Industrial, Commercial unit which generates wastewater, emits air emissions, generates hazardous waste has to obtain prior permission from concerned Pollution Control Board in form of License/ NOC/ Consent To Establish (CTE), Consent To Operate (CTO) under Air and Water Act & Authorization under Hazardous Waste Rules.

CATEGORIZATION OF INDUSTRIAL ACTIVITIES.

Categorization of Industrial Sectors under Red, Orange, Green and White Category

CPCB has developed the criteria of categorization of industrial sectors based on the Pollution Index which is a function of the emissions (air pollutants), effluents (water pollutants), hazardous wastes generated and consumption of resources.

 The Pollution Index PI of any industrial sector is a number from 0 to 100 and the increasing value of PI denotes the increasing degree of pollution load from the industrial sector. Based on the series of brain storming sessions among CPCB, SPCBs and MoEFCC , the following criteria on ‘Range of Pollution Index ‘for the purpose of categorization of industrial sectors is finalized. 

o Industrial Sectors having Pollution Index score of 60 and above – Red category

o Industrial Sectors having Pollution Index score of 41 to 59 –Orange category

o Industrial Sectors having Pollution Index score of 21 to 40 –Green category

o Industrial Sectors having Pollution Index score incl. & upto 20 -White category

 

 

Consent To Establish/  Consent To Operate

Consent to Establish

Any Industrial or Commercial unit which intends to start any business operation has to apply an application for Consent to Establish (CTE) informing the proposed business activity, its pollution potential and proposed pollution control measures.  It is a kind of prior intimation to concerned Pollution Control Board/ Committee about the project and its pollution potential. Through this application, Pollution Board assess the feasibility and gives permission/consent if the activity is meeting the required norms.

Process                                    

  1. Choose a Conforming area/ permitted industrial area, where manufacturing activity is allowed as per Local Authority Norms.
  2. Prepare project reports, undertakings, water balance charts, details of pollution control equipment and other documents as applicable and required for Consent to Establish application.
  3.  Filing of Consent to Establish application with requisite documents, information and fees.
  4. Once the application submitted is complete and correct in all respect, it goes under scrutiny of Pollution Control Official.
  5. If the application is correct in all respect, the official would process the application for grant of Consent certificate. However if the application is lacking some document or information, then the official will either raise clarification or may also reject the application.

Consent to Operate

After Consent to Establish, Industrial or Commercial unit can establish and install machinery, infrastructure as per requirement. Once all installation and set up work is completed and unit is ready to start operation, then unit has to file for Consent to Operate (CTO) informing the technical information about waste water discharge, air emission load, relevant test reports  including design and details of  pollution control devices.  Through this application, Pollution Board assess the adequacy of pollution control devices and check whether all pollution control norms as applicable are met as per standards and gives permission/consent if meeting the required norms.

Process

  1. Install Pollution Control Devices/ control measures w.r.t Water/Air/Noise Pollution as applicable to your industry.
  2. Get Lab testing done of installed Pollution Control Device from empanelled Lab of Pollution Control Board.
  3. Prepare undertakings, process details, design and details of pollution control equipment, water balance charts and other documents as applicable and required for Consent to Operate application.
  4.  Filing of Consent to Operate application with requisite documents, information, Test Reports and fees.
  5. Once the application submitted is complete and correct in all respect, it goes under scrutiny of Pollution Control Official.
